Agreement: By creating a gym account on GimFox or by accessing the GimFox platform in any way, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use GimFox.

Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Gym Owner", "you", or "Customer") and GimFox ("GimFox", "we", "our", or "us") governing your use of the GimFox gym management platform and all associated services.
By clicking "Get Started", completing the registration process, or otherwise accessing or using GimFox, you confirm that you:
- Are at least 18 years old or have parental/guardian consent
- Have the legal authority to bind your business to these Terms
- Have read, understood, and agree to be bound by these Terms
- Agree to our Privacy Policy and Refund Policy

Service Description
GimFox is a multi-tenant Software-as-a-Service (SaaS) platform designed for gym owners and fitness studio operators in India. The platform provides:
- Member management — registration, profiles, membership assignment, and renewal tracking
- Attendance tracking — punch-in/punch-out with automatic session management
- Workout management — exercise library, template creation, and assignment to members
- Diet management — food library, meal plan templates, and member assignments
- Enquiry CRM — Kanban pipeline for managing prospective member leads
- Finance tracking — income and expense management with category-wise reporting
- Email communications — per-gym SMTP configuration, bulk mailing, and automated renewal reminders
- Analytics and reports — dashboards, charts, and printable reports
- Member portal — mobile-first app for gym members to view plans, log workouts, and manage their profile
Features available to your gym depend on your active subscription plan. GimFox reserves the right to add, modify, or discontinue features with reasonable notice.

Accounts & Registration
Gym Owner Account
- You must provide accurate and complete information during registration
- You are responsible for maintaining the security of your gym code, email, and password
- You must notify us immediately at hello@gimfox.com if you suspect unauthorised access
- One gym account corresponds to one physical gym or fitness business location
Sub-Admin Accounts
- The gym superadmin may create additional admin accounts with granular module permissions
- You are responsible for all actions taken by sub-admins on your account
- Sub-admin credentials must not be shared outside your organisation
Member Accounts
- Gym members access GimFox through a separate member portal using your gym code and their credentials
- You are responsible for ensuring your members are informed about their use of the platform

Subscription & Billing
Plans
GimFox offers multiple subscription tiers (Basic, Pro, Premium). Each plan includes a defined set of features and a maximum member count. Plan details and pricing are available on our Pricing page.
Billing
- Subscriptions are billed monthly or annually in advance, as selected at the time of purchase
- All prices are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise
- Failed payments may result in temporary suspension of your gym account
Upgrades & Downgrades
- You may upgrade your plan at any time; the change takes effect immediately
- Downgrades take effect at the start of the next billing cycle
- Feature access reflects your current active plan and updates in real-time as your plan changes

Acceptable Use
You agree to use GimFox only for lawful purposes and in accordance with these Terms. You must not:
- Use the platform for any purpose other than managing your legitimate gym or fitness business
- Attempt to access another gym's database, data, or admin interface
- Reverse engineer, decompile, or attempt to extract the source code of GimFox
- Upload malicious code, viruses, or any software designed to damage or disrupt the platform
- Use automated scripts or bots to scrape or extract data at scale
- Resell, sublicense, or commercially redistribute GimFox to third parties
- Enter false, misleading, or fraudulent data about members or transactions
- Use GimFox in a way that violates any applicable Indian or international law
Violation of these policies may result in immediate account suspension without refund.

Intellectual Property
GimFox's IP
The GimFox platform — including its code, design, branding, user interface, documentation, and all associated intellectual property — is owned exclusively by GimFox and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable right to use the platform.
Your Content
You retain full ownership of all data you enter into GimFox — member records, financial data, workout plans, diet plans, and any other content. By using GimFox, you grant us a limited licence to store and process this data solely for the purpose of delivering the service to you.

Data Ownership
Your gym's data is yours. We will never use your gym's member data, financial data, or operational data for any purpose other than delivering GimFox to you. Upon account termination:
- You may request a full data export before your account is closed
- Data is retained for 60 days after termination, then permanently deleted
- We provide data in standard formats (CSV/SQL) upon written request

Availability & Uptime
We strive to maintain high availability of the GimFox platform but do not guarantee 100% uptime. Scheduled maintenance will be communicated in advance where possible. GimFox shall not be liable for losses resulting from service interruptions beyond our reasonable control, including infrastructure outages, third-party failures, or force majeure events.

Termination
By You
You may cancel your GimFox subscription at any time by contacting us. Your account will remain active until the end of the current billing period. See our Refund Policy for details on refunds upon cancellation.
By GimFox
We may suspend or terminate your account immediately without notice if you:
- Violate any provision of these Terms
- Engage in fraudulent activity
- Fail to pay outstanding subscription fees after a 7-day grace period
- Use the platform in a way that threatens the security of other gym accounts
Upon termination for cause, no refund will be issued.

Limitation of Liability
To the maximum extent permitted by applicable law:
- GimFox is provided "as is" without warranties of any kind, express or implied
- GimFox's total cumulative liability to you shall not exceed the amount you paid to us in the 3 months preceding the claim
- We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform
- We are not liable for data loss caused by your own actions, accidental deletion, or events outside our control
Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.

Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
